Terms of Service

These Terms of Service ("Terms") govern your use of the FGMNT platform, website, and related services ("Services"). By signing up, subscribing, or using the Services, you agree to these Terms and to our Privacy Policy and other policies linked from this site. These Terms include our Refund & Return Policy, Legal & Export restrictions, and Promotion Terms (see sections below).
1. Services
FGMNT provides a software platform for businesses to create, manage, and share content and messaging. Access is granted by subscription. Services are offered to customers in the United States; we may make Services available in other jurisdictions at our discretion.
2. Account & Subscription
You must provide accurate information when creating an account. You are responsible for keeping your credentials secure. Subscription fees are charged in accordance with your plan and our Refund & Return terms (Section 9 below). Payment processing is handled by our payment provider (CardPointe); by paying, you agree to their processing terms as applicable.
3. Acceptable Use
You may not use the Services for any illegal purpose or in violation of applicable laws. You may not abuse, reverse engineer, or attempt to gain unauthorized access to the Services or any third-party systems we use. Use of messaging features is subject to our Messaging Compliance & SMS Policy.
4. Intellectual Property
FGMNT and its licensors own all rights in the platform, branding, and materials we provide. You retain rights in content you create and upload; you grant us the license necessary to operate the Services (e.g., storing, displaying, and transmitting your content as you direct).
5. Termination
You may cancel your subscription at any time. We may suspend or terminate your access if you breach these Terms or for operational or legal reasons. Termination does not entitle you to a refund (see Section 9).
6. Disclaimers
The Services are provided "as is." We do not guarantee uninterrupted or error-free operation. We are not responsible for content you or your end users create or for the actions of third-party providers (e.g., messaging or payment processors).
7. Limitation of Liability
To the maximum extent permitted by law, FGMNT is not liable for indirect, incidental, special, or consequential damages, or for any loss of data or profits arising from your use of the Services. Our total liability is limited to the amount you paid us in the twelve months preceding the claim.
8. Governing Law
These Terms are governed by the laws of the United States. Any dispute shall be resolved in the courts of the United States.
9. Refund & Return Policy
FGMNT is a software platform (ISV). We do not sell or ship physical goods. We do not offer refunds or returns for subscription fees or other payments. All charges are final. By completing payment, you acknowledge that you have read and accept this policy. You may cancel your subscription at any time through your account settings. Cancellation will stop future charges but does not entitle you to a refund for any period already paid.
10. Legal & Export Restrictions
Use of the Services may be subject to export control, sanctions, and other legal restrictions. The Services and underlying technology may be subject to the export and use laws of the United States and other jurisdictions. You may not use, access, or allow the Services to be used in any country or by any person where such use would violate U.S. or other applicable export control, sanctions, or other laws. You are responsible for determining that your use complies with the laws of your location. You may not use the Services if you are located in, or are a national or resident of, a country subject to comprehensive U.S. sanctions, or if you are listed on any U.S. or other applicable government list of prohibited or restricted parties. FGMNT may suspend or terminate access if we believe use violates applicable law. You agree to cooperate with any reasonable compliance or audit requests.
11. Promotion Terms
From time to time FGMNT may offer promotions, promo codes, discounts, or other offers ("Promotions"). All Promotions are subject to terms determined by FGMNT at the time of the offer. Eligibility, duration, discount amount, usage limits (e.g., one per customer), and any other conditions are set by FGMNT and may vary by Promotion. We reserve the right to modify or withdraw Promotions at any time. Promotions may not be combined with other offers unless we expressly allow it. Promotions apply only to eligible plans and sign-up or renewal events as specified. Our standard Terms of Service and Refund & Return terms (Section 9) apply to all subscriptions, including those made with a Promotion.
12. Changes
We may update these Terms from time to time. Continued use of the Services after changes constitutes acceptance. Material changes may be communicated via email or a notice in the platform.
