Messaging Program Registration Statement

This Messaging Program Registration Statement describes how messaging programs are operated through the FGMNT platform ("FGMNT," "we," "us," or "our"). This document is intended to support transparency, carrier compliance, and delivery partner requirements for SMS and MMS messaging.
1. Platform Overview
FGMNT provides a software platform that enables businesses ("Customers") to create, manage, and deliver communications to their audiences via SMS, MMS, and related messaging channels.
FGMNT acts solely as a technology provider and does not originate or control Customer messaging content.
2. Program Type
Messaging programs operated through FGMNT typically include:
- Business updates and announcements
- Customer engagement communications
- Promotional or marketing messages
- Informational alerts
- Event or appointment reminders
- Content update notifications
All programs are initiated and controlled by Customers.
3. Sender Identification
Customers are required to:
- Clearly identify their business or brand in messages
- Avoid misleading or deceptive sender identities
- Ensure recipients understand who is sending the message
FGMNT reserves the right to suspend programs that fail to provide clear sender identification.
4. Consent & Opt-In Requirements
Customers must obtain explicit recipient consent before sending messages.
Minimum consent requirements include:
- Clear disclosure that SMS or MMS messages will be sent
- Identification of the sending business
- Notice that message and data rates may apply
- Explanation of message frequency where applicable
- Clear opt-out instructions
Example consent language:
"By providing your phone number, you agree to receive text messages from [Business Name]. Message and data rates may apply. Message frequency may vary. Reply STOP to opt out."
Customers are responsible for maintaining records of consent.
FGMNT does not collect or verify consent on behalf of Customers.
5. Opt-Out Management
Recipients must be able to opt out at any time.
Customers must honor common opt-out keywords including:
- STOP
- END
- CANCEL
- UNSUBSCRIBE
- QUIT
Messages must cease after opt-out unless renewed consent is obtained.
6. Prohibited Content & Use Cases
Messaging programs may not include:
- Spam or unsolicited messaging
- Fraudulent, deceptive, or misleading content
- Harassment or abusive messaging
- Sexually explicit content
- Hate speech or violent content
- Illegal goods or services
- High-risk financial schemes
- Unauthorized gambling or sweepstakes
- Content restricted by carriers or delivery partners
FGMNT may modify restrictions to align with carrier, regulatory, or delivery partner policies.
7. Message Frequency
Message frequency varies by Customer program and recipient interaction.
Customers must avoid excessive messaging and must communicate expected frequency during opt-in.
8. Delivery Infrastructure
FGMNT utilizes third-party messaging delivery partners and downstream carrier networks.
Message delivery may be subject to:
- Carrier filtering
- Throughput limits
- Anti-spam protections
- Delivery partner policies
FGMNT does not guarantee message delivery.
9. Monitoring & Enforcement
FGMNT may monitor messaging activity to protect platform integrity, including:
- Unusual volume spikes
- High complaint or opt-out rates
- Spam-like sending patterns
- Regulatory or carrier violations
FGMNT may suspend, throttle, or terminate messaging programs at its discretion to maintain compliance.
10. Customer Responsibility
Customers are solely responsible for:
- Compliance with TCPA, CAN-SPAM, and applicable laws
- Obtaining and maintaining recipient consent
- Message content legality
- Audience management and list hygiene
FGMNT acts only as a technology facilitator.
11. Compliance Alignment
Messaging programs must comply with:
- Applicable federal and state laws
- Carrier requirements
- Delivery partner policies
- Industry best practices for consent-based messaging
