Messaging Compliance & SMS Policy

This Messaging Compliance & SMS Policy ("Policy") governs the use of messaging features within the FGMNT platform ("Services"). This Policy forms part of the FGMNT Terms of Service.

FGMNT provides messaging tools but does not originate, approve, or control customer communications. Customers are solely responsible for lawful use of messaging features.


1. Purpose

FGMNT utilizes third-party messaging infrastructure and delivery partners to transmit SMS and MMS messages.

This Policy exists to:

  • Protect recipients from unwanted messaging
  • Maintain compliance with applicable laws
  • Align with carrier and delivery partner requirements
  • Maintain platform integrity and deliverability

2. Consent Requirements

Customers must obtain clear and verifiable consent before sending messages.

Required consent standards include:

  • Explicit opt-in by the recipient
  • Clear disclosure that messages will be sent
  • Identification of the sender
  • Notice that message and data rates may apply
  • Clear opt-out instructions (e.g., STOP)

Example compliant language:

"By providing your phone number, you agree to receive text messages from [Business Name]. Message and data rates may apply. Message frequency may vary. Reply STOP to opt out."

Customers must maintain records of consent.

FGMNT does not manage or verify consent on behalf of customers.

3. Opt-Out Requirements

Customers must honor opt-out requests immediately.

The following keywords must be treated as opt-out requests:

  • STOP
  • END
  • CANCEL
  • UNSUBSCRIBE
  • QUIT

Once a recipient opts out, messaging must cease unless new consent is obtained.

4. Prohibited Messaging Content

The Services may not be used to send messages involving:

  • Spam or unsolicited communications
  • Fraudulent or deceptive content
  • Harassment or abusive messaging
  • Sexually explicit material
  • Hate or violent content
  • Illegal products or services
  • Payday loans or high-risk financial schemes
  • Gambling or sweepstakes without proper authorization
  • Regulated products where prohibited by carriers or law
  • Messaging directed at minors where restricted

FGMNT may update prohibited categories to align with carrier or delivery partner requirements.

5. Messaging Infrastructure & Delivery

FGMNT uses third-party delivery partners to transmit messages.

You acknowledge that:

  • Message delivery is subject to downstream carrier and delivery partner policies
  • Messages may be filtered, delayed, or blocked
  • Delivery is not guaranteed

FGMNT is not responsible for delivery failures caused by third-party providers or carriers.

6. Rate Limits and Abuse Prevention

FGMNT may monitor messaging activity to prevent abuse, including:

  • Excessive volume spikes
  • Spam-like behavior
  • High complaint rates
  • Unusual sending patterns

FGMNT may suspend, throttle, or terminate messaging access when necessary to protect platform integrity or comply with partner requirements.

7. Customer Responsibility

Customers are solely responsible for:

  • Compliance with TCPA, CAN-SPAM, and applicable laws
  • Obtaining and maintaining recipient consent
  • Managing recipient preferences
  • Ensuring lawful message content

FGMNT acts only as a technology provider.

8. Enforcement

FGMNT may suspend or terminate messaging capabilities at its sole discretion if use of the Services:

  • Violates this Policy
  • Creates legal or operational risk
  • Violates delivery partner or carrier policies

9. Changes to this Policy

FGMNT may update this Policy periodically. Continued use of messaging features constitutes acceptance of the revised Policy.
